1. Parties; Firm Identification; Scope
These Terms are entered into between Law Offices of Stefan J. Erwin, LLC, a New Jersey limited liability company, and any individual or entity that accesses the Website or any communication service offered by the Firm. The Firm is organized in accordance with RPC 7.5; the designated office under R. 1:21-1 is 1435 Morris Avenue, Suite 2M, Union, NJ. These Terms do not constitute a retainer agreement.
2. Attorney Advertising
The Website is attorney advertising within the meaning of RPC 7.1 and RPC 7.2. No attorney holds himself or herself out as a "specialist" or "certified" within the meaning of RPC 7.4 unless expressly stated. Any award, ranking, or comparative recognition appearing on the Website is accompanied by the following disclaimer: "No aspect of this advertisement has been approved by the Supreme Court of New Jersey." Prior results do not guarantee a similar outcome.
3. No Attorney-Client Relationship Through Website Use
Your access to or use of the Website — including browsing, reading content, completing a contact form, transmitting information by email, or texting the Firm — does not create an attorney-client relationship. Information published on the Website is general in nature and does not constitute legal advice. Nothing on the Website constitutes a solicitation within the meaning of RPC 7.3.
4. Formation of the Attorney-Client Relationship
An attorney-client relationship shall be formed only upon: (a) completion of a conflicts check; (b) execution of a written engagement letter identifying the scope of the representation and fee arrangement; (c) tender of payment in accordance with the engagement letter; and (d) the Firm's written confirmation of engagement.
5. Prospective Clients; Confidentiality of Unsolicited Submissions
Do not send confidential information. Consistent with RPC 1.18 and ACPE Opinion 695, the Firm owes no duty of confidentiality with respect to unsolicited submissions before the Firm agrees to consider whether to undertake representation.
6. Electronic Communications Not Secure or Privileged
The Internet is not a secure medium. Communications transmitted to or from the Firm before the formation of an attorney-client relationship are not protected by the attorney-client privilege.
7. Short Message Service (SMS) Terms
The Firm's SMS program complies with the federal Telephone Consumer Protection Act, 47 U.S.C. § 227, 47 C.F.R. § 64.1200, CTIA Messaging Principles, the A2P 10DLC program, CAN-SPAM, and New Jersey law including the Do Not Call Statute and Unsolicited Text Message Act.
- Program scope. Transactional case-related messages (appointment reminders, court dates, document requests, status updates) and two-way conversational messages. No marketing messages.
- Consent. By providing your mobile number and affirmatively enrolling, you consent to receive transactional and conversational messages. Consent is not a condition of representation.
- Message frequency. Varies by matter activity. Message and data rates may apply through your wireless carrier.
- Help. Call (908) 845-3303 or email Info@ErwinEsq.com.
- Opt out. Reply STOP, QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT, or contact us by other reasonable means. Processed within ten (10) business days.
- Quiet hours. No messages initiated before 8:00 a.m. or after 9:00 p.m. local time at the called party's location.
8. Disclaimers; No Warranty
The Website is provided "AS IS." The Firm disclaims all warranties to the maximum extent permitted by law. Statutes, regulations, court rules, and case law are subject to amendment.
9. Limitation of Liability
To the maximum extent permitted by applicable law, and subject to the Firm's obligations under the New Jersey Rules of Professional Conduct, in no event shall the Firm be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Website.
10. Intellectual Property; Limited License
All content on the Website is the property of the Firm or its licensors. You are granted a limited, revocable, non-exclusive, non-transferable license to access and view the Website for personal, non-commercial, informational use only.
11. Third-Party Links
The Website may contain hyperlinks to third-party websites. The Firm does not endorse or assume responsibility for the content of any third-party site.
12. Age Requirement
The Website is intended for adults. You represent that you are at least eighteen (18) years of age.
13. Fees; Right to Fee Arbitration
Fees for legal services are governed exclusively by a separately executed written engagement letter, in compliance with RPC 1.5. You have the right to elect fee arbitration under Rule 1:20A of the New Jersey Court Rules. Nothing in these Terms or in any engagement letter shall be construed to waive that right.
14. Governing Law; Venue; RPC Controls
These Terms are governed by the laws of the State of New Jersey. Venue is exclusively in the Superior Court of New Jersey in Union County. In the event of any conflict between these Terms and the New Jersey Rules of Professional Conduct, the Rules of Professional Conduct shall control.
15. Modifications
The Firm reserves the right to modify these Terms by posting revised Terms with a new Effective Date. No modification shall retroactively alter an executed engagement letter without the client's written consent.
16. Miscellaneous
These Terms (together with the Privacy Policy and any executed engagement letter) constitute the entire agreement. If any provision is held invalid, the remaining provisions remain in effect. No waiver shall be valid unless in writing.
